C- Personal data is processed fairly and lawfully
In practice this means that you need to:
- There must be legitimate reasons for collecting and using personal data;
- Not to use personal data in ways that are unjustified and have negative effects on the individuals concerned;

D- What is meant by fair processing of personal data?
The processing of personal data must above all be fair and meet the relevant conditions for processing. “Processing” of personal data means the collection, use, disclosure, retention, rectification, erasure, transmission, international transfer of personal data, as well as their destruction, and if there is any aspect of the processing that is unfair, there will be a violation of the first principle of personal data protection.
The principle of fair processing generally requires being transparent, clear and open with individuals/subjects about how their information will be used. Transparency is always important, but especially in a situation where individuals/subjects have a choice as to whether they wish to enter into a relationship with the Albanian Besa Capital Foundation.
Assessing whether information is being processed fairly depends in part on the way it was obtained. The law on the protection of personal data provides that information collected must be treated fairly if it is provided by a person who is authorized to provide it.

This is another term that is provided as a criterion for the collection and processing of personal data, in the law on the protection of personal data, a law on which the Albanian Besa Capital Foundation relies for the collection and processing of personal data of its grantees.
Processing may be unlawful if it results in:
- Breach of trust in a duty. Such a duty may be stated or implied by the content of the information or by the fact that it was collected in circumstances where such information is expected;
- Exceeding legal powers;
- Breach of a binding contractual agreement;
- Violation of specific legislation or regulations;
- Violation of the European Convention on Human Rights;
